Software account and delivery
Hosted software access terms
Version 1.0 · October 13, 2026
These terms govern the software purchase, sign-in, billing and download service operated by Gabriel San Roman, doing business as Open Waves. The separate Software License v1.2 governs use of the downloaded SDK. The game's terms govern the game.
1. Your software account
Use a purchaser email you control. Sign-in uses a short-lived emailed code and an essential session cookie. Keep codes and session access private. You must have authority to buy and accept terms for the named licensee. A commercial license covers the application recorded on your order; contact us to correct an error. Buying the SDK does not create a game account, supply a beta invitation or grant access to hosted game services.
2. Payment confirmation and activation
Payment is processed by Stripe. A checkout return page, email code or pending payment is not proof of a paid entitlement. Downloads become available after the service receives payment confirmation and you provide the licensee details and accept the applicable terms. Some payment methods take additional time to confirm. If a purchase does not appear, refresh your software account and contact us with the checkout email and receipt reference; do not submit another payment solely because delivery is pending.
The order records the purchased tier, billing interval and package release or update entitlement. Personal Monthly costs $100 for the first month, then $20 each month. Personal Annual costs $280 for the first year, then $180 each year. Commercial subscriptions cost $200 each month or $1,800 each year. One-time prices are $100 Personal and $200 Commercial, before applicable taxes. Prices, taxes, the actual charge and renewal information must be shown before payment. Before activation, the account links to the saved terms for your order, which may differ from the latest public website text. Your acceptance record identifies that terms version and integrity hash. The account provides available downloads and a license certificate. Neither a certificate nor an account permits sharing reusable SDK packages with unlicensed developers.
3. Subscriptions and cancellation
Subscriptions renew at the chosen monthly or annual interval until cancelled. Use “Manage billing / cancel renewal” in your software account to open billing management. You may also request cancellation through our contact form. Cancellation stops future renewals and update access continues through the paid term shown in your account. Annual charges are paid upfront; they are not monthly installments.
Ordinary expiry or cancellation ends future update access, while your last lawfully downloaded version remains usable under its Personal or Commercial license. A one-time purchase includes the purchased version and no future SDK updates. No release frequency or particular future feature is promised. Refunds and remedies required by applicable law are unaffected.
4. Availability and your backups
The hosted service can be interrupted for maintenance, security, provider outages or changes. No specific uptime or indefinite storage of every historical release is promised. Keep private backups of the package, included terms and certificate you acquire. A service outage, a closed account or the end of a subscription does not by itself revoke an existing perpetual Software grant. If paid delivery fails, contact us to arrange delivery or request a refund under the Software License.
5. Appropriate use and access protection
Do not attempt to access another buyer's purchases, bypass payment or license checks, share sign-in codes, resell download access, overload the service or interfere with its security. We may temporarily limit or suspend hosted access to protect accounts, investigate unauthorized access, resolve payment disputes or comply with law. Restrictions on hosted access do not automatically terminate a Software grant; termination of that grant follows the Software License and applicable law. Contact us if you believe access was restricted in error.
6. Records and privacy
We record purchaser and licensee details, transaction references and status, subscription periods, accepted terms versions and activation/download records to provide access and evidence of the purchased rights. Authentication and security records protect the service. See the Privacy Policy for providers, retention and your choices. Transactional account emails are separate from optional marketing; accepting these terms is not marketing consent.
7. Scope, changes and contact
The Software License's ownership, third-party rights, mandatory consumer protections, liability limitations and governing-law provisions also apply where relevant to this hosted service. Later website changes do not retroactively replace the terms of a downloaded software grant. Material changes to ongoing hosted access will be communicated as appropriate before taking effect. Keep the terms version included with your release. Questions or corrections: contact Open Waves.
